Most travelers aren’t very safety conscious. Oddly, they seem to leave their common sense back home when they step off the tarmac and on to the plane. The opposite is required of tourists and expats who spend any meaningful amount of time in foreign countries.

If a flight was cancelled, could passengers demand for hotel accommodation? If a passenger is sick and was denied to board the aircraft, could he or she sue the airline?

Air passengers have many rights under the law. The question is, how well does one know these rights?



Let's dissect the Air Passenger Bill of Rights as explained by Civil Aeronautic's Board chief legal officer, Wyrlou Samodio.

First, he noted that passengers need to be protected. "Airlines might commit many mistakes, but passengers should not suffer from these," he said.

While airlines have the responsibility to inform passengers about their rights, Samodio said the Supreme Court (SC) says passengers should read the airlines' terms and conditions on their offers and services.

"According to the SC, airlines have the obligation to inform and explain to passengers the terms and conditions, including restrictions, of their tickets. But passengers also have the obligation to read them," he emphasized.

Let's see what are the basic rights or air passengers, and some examples.


1. Right to information

It is important that passengers be informed of the specific details of airline tickets. It should be clear to him or her what kind of ticket did he or she purchased -- is it a regular ticket or a promo ticket?

Know if the ticket is rebookable, reroutable, refundable, the ticket's expiry or validity, seats available, travel period, and other conditions.

"Accurate information aids the passengers to make the right choice of they are going to buy the ticket or not," Samodio said.



2. Right to service purchased

* Passengers should not be considered "late" or "no show" if they are within the carrier's cord in the check-in area at least an hour before the estimated time of departure.

Samodio said passengers must know that the extra two hours they are often advised to be at the airport is actually essential, since there might be long queues at the check-in counter. The Bureau of Immigration may also question some documents of the passengers, so one really needs to allot extra time.

* A passenger who was considered "late" may be denied check-in, but he or she should be directed to a rebooking counter.

* For international flights, the airlines are required to open the check-in counters at least two hours before the expected time of departure.

* There should be designated counters for persons with disabilities, senior citizens, and others needing assistance. Samodio said these counters don't necessarily mean physical counters, because there are airports that may be too small to have additional counters. What's important is that airlines should give priority to these individuals.

"These passengers, however, must note that not all of their companions will be accommodated in the priority lane. Of course if they are with 10 people, for example, not all of them will be accommodated. A PWD does not need 10 people to assist him or her," Samodio explained.

Especially for those who have booked their tickets online, they need to inform the airline staff if they need assistance or if they are PWDs.

“It's not always obvious if someone is a PWD," he emphasized.

Exceptions to the right to board

Yes, passengers have rights, but there are exceptions.

Among these are safety and security reasons, health concerns, non-appearance to the boarding gate.

Samodio said a passenger who is sick but Is not infectious, should be allowed to board the aircraft.

In case of government requisition of space, a person may be denied to board. For example, police authorities caught a criminal somewhere far and they would need to transport him or her immediately, they can get the seats or space that they need. Note, however, that they should seek a permit first from the CAB before they can get a space. Also, they need to pay the passengers for the seats that they will get.


3. Right to compensation

Are airlines liable for every delayed or cancelled flight? Samodio said it's not the airline's fault if the flight cancellation was caused by a severe weather condition. Thus, they are not obliged to provide passengers with hotel accommodations.



Passengers should note these rights whenever they experience flight delays:

* For delays of at least three hours, whether or not the carrier is at fault, they are entitled to refreshments or meals, free phone calls and email, and first aid, if necessary. Airlines should also rebook their tickets (without additional charge) to the next flight available, or within 30 days.

They can also opt to refund the fare value, including taxes and surcharges. Passengers may also be endorsed to another air carrier without paying any air fare difference.

* For tarmac delay of at least two hours (meaning, you passengers are already inside the aircraft), the airlines should provide them with sufficient food and beverages. The pilot shall give updates every 30 minutes. If the delay reaches three hours, passengers should be offloaded.

* If a flight was cancelled and it was not the airline's fault (e.g. caused by typhoon; due to security reasons), passengers may refund the value of the fare, including taxes and surcharges. They can also rebook their ticket.

* For complaints regarding lost or damaged baggage, Samodio emphasized that a passenger should first approach the air carrier to complain, as it is also the carrier that is responsible for their baggage.

"We follow the Montreal Convention. Under this, carriers are liable for proven damages up to 100,000 SDR (special drawing rights), a mix of currency values established by the IMF (International Monetary Fund)," he said.

He also highlighted that passengers must declare if they have valuables inside their luggage.

"Sometimes, to avoid paying duties, passengers don't declare their valuables. Then they would complain if their jewelry, for instance, is missing. How would the airline know if it's true if they did not declare it?"

Meanwhile, Samodio reiterated that when we talk about the "right to compensation", compensation does not automatically refer to monetary compensation.

"Compensation could either be in the form of cash, or in the form entitlements such as food, vouchers, tickets, accommodation," he explained.

He also noted that compensation comes from the airline, not from the government.

Tavern by the Lake is a new restaurant in Tagaytay that offers good food and good ambiance to its visitors. Opened in early 2018, Tavern is very promising - the quality of food and service they is one of the best in Tagaytay. This restaurant is also the provider of breakfast to the Lakeview Suites guests.

But first, let me tour you inside Tavern :)


When me and family booked a stay in the Lakeview Suites, there was nowhere to eat nearby besides Tavern. Although, we were given stubs for complimentary breakfast. We were a bit hesitate to go inside thinking of their price and what kind of food they serve.

Until we realized that the free Wi-Fi access is only available in the restaurant. So when went up and took a look inside.



"Wow!"


Our eyes got wider upon our entrance to Tavern. Looking outside, you won't expect so much. But once you get in there, it will take you to a different place!



THE AMBIANCE

Tavern is located at the second level just above the suites. The whole area is packed with stylish furniture and fossil flowers. You'll also notice some old items (antiques) that compliments with the rustic design of the interior.


I also love the umbrellas on the ceiling (lakas maka-IG worthy!) and the sofas, they're both colorful and lovely to the eyes.

Don't forget to take a selfie with on this side! Ang lakas din maka-into the woods yung outside area!


Overall, this place is very relaxing. It is very good for family gatherings or barkada food trip in Tagaytay!



THE FOOD

We stayed in the Lakeview Suites for a couple of nights and we had all our meals at Tavern. So let me just tell you our food experience during our stay.

First night, we were welcomed with their hot Bulalo Soup (good for sharing) and partnered with Salted Egg Chicken.


I've been to Tagaytay for several times and tasted different Bulalo and I can say that this one they have here can match up with the best in the city.

The Salted Egg Chicken on the other hand is my first-time (I've tried different dishes with salted egg before but it's my first-time to try it on a fried chicken). The salted egg was spread outside the chicken breading to add taste to it. The chicken was cut like you are eating chicken wings. It was good and it was plenty. We took out some of it after dinner and have them as snack before going to bed.


The next morning we had our first breakfast. It's complimentary. We had our choice from their menu. We tried their Corned Beef with egg and fried rice and Bacon and Waffle also paired with fried egg and rice and sides.



It was my first-time to eat corned beef with plenty of onions and a veggie (cuts of cabbages I guess). It was nice. It was garlicky and the taste of onions were savoring to my mouth.

The bacon and waffle on the other hand were also good. The bacon was not salty but still tasty and crunchy. The waffle (in disclaimer) was a pancake in butter. Still good because of butter. But it would be better if they have syrup for it.


Lunch time! That's the time we had two of their chef's specialties, the Salmon Head Sinigang Sa Miso and Baby Back Ribs.

The Sinigang sa Miso is Rachel's favorite eversince! So I let her verdict this one. The taste of miso was there. The sinigang was perfectly sour with a bit of bitterness and spiciness. The salmon head was tender and melt-in-the-mouth. It just a little hard to eat it due to its bones. But still, it's a salmon. It's one of my favorite seafood (especially from fishes).

The baby back ribs were also tender and melt-in-the-mouth. It was nicely poured by their specialty sauce that makes it even tastier.

Both were a good match to rice!

And in just a few hours we had our second and the last dinner. This time, we were served Crazy Asian Chicken, Sisig Cups, Tuyo Pasta and Tinapa Platter Rice. All of these food we were thinking, "bibitayin na ba tayo?" 


The chicken dish was also cut like the chicken wings. It was crispy and poured with sauce that adds delicious taste to it.

The sisig cups were also another "new" to us! Imagine this: spicy crispy sisig wrapped like a deep-fry dumplings. That's it! It became our most favorite food that night!

The tuyo pasta on the other hand is not really new to me. But I appreciate the texture of their pasta, the cheesiness of it and of course, my all-time favorite Filipino dish - tuyo.


All of these are paired with the tinapa rice? Flavor overload! Hahaha

The next day we had the same meal for breakfast. :)

DESSERTS

Both of the desserts we tried here were our first-time, too.


This one is their Buco ala Tavern. It's a coconut-based desserts sweetened by sugar. The texture was soft and slimy.

During our lunch we had a taste of their Maruya ala mode. This time they served a big sized maruya (fried sliced banana) poured with chocolate syrup and topped with vanilla ice cream.

Overall experience? Their food was very good (two thumbs up) and highly recommended! We even took out some of the food we can't finish because of their size of their servings! Haha their service is excellent! They were very accommodating and easy to talk with. When you have requests or anything you need during your stay, don't hesitate to ask, they are easy to approach to.


NOTE

  • Most of their meals are good for sharing (2-3).
  • Besides lemonade, they also serve canned drinks, beers and wines.
  • They also serve food for kids.

HOW TO GET TO TAVERN BY THE LAKE

Lakeview Suites is just 5 kilometers away from the Tagaytay Rotunda via the Tagaytay-Nasugbu Highway. You are less than a kilometer away once you passed the Mushroom Burger establishment. After that, you will pass by two gasoline stations: Shell and Petron. At the corner of the road is Café Carmencita, at which point, you need to turn left, which is already Lakeview Road. About a 100 meters from the turning point is the gated Lakeview Suites.

Via Public Transportation

  • Catch a bus ride to Tagaytay or Nasugbu.
  • Drop off the corner of Mahogany Ave and Tagaytay-Nasugbu Hwy where you can see a police station.
  • Walk or hire a tricycle nearby to bring you inside The Lakeview Suites (or Tavern by the Lake).
Parking space is available for those who are driving here.

THE DELUXE SUITE

The room has a queen-sized bed, a closet, a restroom with complimentary sanity kit, a Smart TV with cable and aircondition.

It has two lamps and a painting on the wall. You will feel very homey from its colors and ambiance.

Behind the door is this balcony that has two chairs and a table - perfect place to chill and spent me-time. It is the best way to unwind!


This suite is good for couple.

You'll witness this fantastic view of Taal Lake and the ridge from left to right. IG-worthy indeed!


Above the Deluxe Suites is a view deck where it has couches and beanbags.

It has a breathtaking view of the rest of Batangas.

THE GARDEN AND CHAPEL

One of the main features of this place is their lush garden. This part of the Lakeview Suites can accommodate up to a hundred people for an event such as wedding or party.

The garden is surrounded by different plants and flowers, Bermuda grass, cobble stone walkways and a wishing well.

It also boasts their mini chapel with a beautiful design to complement with the whole area. From the garden, you still have the amazing view of the ridges and the Taal.


THE TAVERN

Tavern by the Lake  is the hotel's in-house restaurant which also serves breakfast for their guests.


It has a cozy and very homey vibe with a touch of colorful interior. Non-guests can also visit and dine in here.

The Deluxe Suite with Kitchen – There is only one Deluxe Suite with kitchen. This is perfect for those couples or small families who want to have an extended stay in Lakeview Suites. The room is separate from the kitchen and dining. The room has a queen size bed, air-conditioning, and a 40-inch flat screen Smart TV. The kitchen and dining have a refrigerator, a microwave oven, water kettle and basic plates and utensils.

THE FAMILY SUITE (P5,700 - 4pax)

There are five family suites: four are located on the ground floor and one on the attic floor. These suites are designed for big families or groups. The four rooms on the ground floor have twin – queen size beds, a sofa, a bay window, a private toilet, and bath, has air-conditioning and has a 50-inch flat screen TV. The suite on the attic, on the other hand, has a queen size bed and a double deck bed. It has a private toilet and bath, air-conditioning and a 40-inch flat screen Smart TV.
